- In the realms of human rights and the Initiative, the current draft of the post-2015 agenda is a considerable disappointment. The almost complete omission of substantive references to human rights in the draft is a throwback to the United Nations development decade strategies of the 1960s and 1970s. However, they were drafted at a time when the human rights framework was in its infancy and development was seen largely as a technocratic process. Similarly, the very low standards set in relation to social protection are inconsistent with the high-flown rhetoric of ending poverty in all its forms everywhere. As it stands, the first goal proposed by the Open Working Group on Sustainable Development Goals might be considered to be in violation of deceptive advertising laws designed to protect consumers.

- Often, States invoke grounds of public safety, health or security in an attempt to justify the restriction of human rights through penalization measures. However, human rights law establishes strict requirements for the imposition of limitations on individual rights. Any restriction on the enjoyment of human rights by those living in poverty must comply with several safeguards, including requirements that they be legally established, non discriminatory and proportionate, and have a legitimate aim. The burden falls upon States to prove that a limitation imposed upon the enjoyment of rights by those living in poverty is in conformity with international human rights law.

- Any form of discrimination, such as that based on sex, race, ethnicity or religion, against workers must be prohibited. Workers' remuneration must be fair, allowing for a decent living for workers and their family. Equal remuneration for work of equal value must also be ensured without discrimination of any kind; in particular, women must enjoy equal pay with men. Special protection for women during pregnancy, and for persons with disabilities, must also be put in place. To ensure the implementation of these obligations, States must regulate labour markets and establish mechanisms to strengthen the accountability of private actors. A greater number of avenues for dialogue between employers and workers, and the opportunity for workers to participate in the design and implementation of employment policies, will further assist States in meeting their human rights obligations.

- Considering that the majority of people living in poverty earn their livelihoods in the informal sector, under difficult conditions and receive low and irregular wages, policies should prioritize improving their working conditions and extending formal social protection to them. To this end, policymakers should consider encouraging the formalization of informal firms, and specifically of employment relations. These measures have the potential to reduce labour market inequality and to extend the coverage of labour institutions to groups that were previously excluded. States should ensure, however, that such measures are taken without increasing poverty and vulnerability.

- The obligations of non-discrimination and equality oblige States to ensure that employment creation policies benefit all sectors of society equally. Policies that increase the employability (for example, through demand-driven skills development and vocational training) of groups that face specific barriers in their access to employment, such as women, persons with disabilities, young people and indigenous populations, will assist States in fulfilling their human rights obligations. To remove obstacles to employment for women, States should ensure the availability of care services (from the State, the community and the market), the redistribution of paid and unpaid work from a gender perspective and the elimination of all forms of gender discrimination. States are not only obliged to undertake effective legislation to this end, but also to take measures to modify social and cultural patterns of conduct of men and women.

- In several countries, the crises have demonstrated a clear need to maximize means of harnessing resources specifically for the realization of economic, social and cultural rights. From an array of options, States should particularly consider widening the tax base, improving the efficiency of tax collection and reprioritizing expenditures. These types of reforms could help States to achieve a more progressive, equitable and sustainable taxation regime while complying with a human rights framework.

- A human rights approach stipulates that legal and policy measures to strengthen the accountability and transparency of financial systems should be taken. In order for States to meet their duty to protect, the banking sector should be regulated to obligate banking institutions to serve the interests of society by, for example, ensuring access to credit without discrimination, especially those struggling under increased economic burdens. States should ensure adequate means of redress for those adversely affected by the actions taken by financial sector institutions, and adopt regulations that discourage harmful practices by providing for accountability mechanisms that penalize risky behaviours and prosecute perpetrators.

- In order to move towards women's equal enjoyment of the right to work, an unpaid care perspective on labour market policies is also crucial. Various measures should be considered to eliminate de facto sex discrimination in employment, for example financing parental leave or maternity benefits publicly, putting in place policies to help people back into work once they have taken time out of the labour force, and incentivizing carer-friendly employment practices and work arrangements, in collaboration with trade unions, industry bodies and employers. Certainly, States must proactively address the persistence of gender-based wage gaps and link job creation to an increase in the supply of care through expanded public services (see below). As the undervaluation of unpaid and paid care work go hand in hand, it is also important to improve working conditions, enjoyment of rights, and pay for care workers and domestic workers.

- In order to achieve greater equality in sharing unpaid care work between women and men, in general and within households, the solutions must be public as well as private. To facilitate long-term change, educational programmes, to be used in schools and communities, should be developed to challenge stereotypical, traditional male and female roles and promote the concept of shared family responsibility for unpaid care work in the home.

- A conception of human rights that implicitly accepts a radical hierarchical distinction between the two sets of rights - civil and political rights, and economic, social and cultural rights - is one that is fundamentally incompatible with international human rights law. - Third, technocratic solutions, no matter how innovative and data-driven, will not work unless they are genuinely empowering of those whom they purport to help. In that regard, extreme poverty is a classic case study in the centrality of human dignity as a guiding principle of human rights. The poor, we have too often been told by our politicians and others, are usually to blame for their own plight, whether because of laziness, incompetence, mendacity, or whatever. Those unjustified stereotypes provide yet another justification for preferring technocratic approaches through which we measure the poor and work out how we are going to make minimal provision for them, at least in the long term. As Keynes reminded us, in the long term we are all dead. Those living in extreme poverty will be dead even more quickly, so that long-term solutions may be little more than an illusion. Short-term empowerment and respect are what is needed. We need to reassert a common humanity, shared responsibilities and the centrality of human dignity.

This is surely not enough. Civil society groups should make clear that a 1960s approach is no longer acceptable in the twenty-first century. Human rights in general should be recognized as both a central goal of sustainable development and a crucial part of the relevant process and a specific right to social protection, as defined in the Social Protection Floor Initiative and ILO recommendation No. 202, should be recognized.

- The Bank needs to remove the roadblock that has been erected by its anachronistic, artificial and unjustifiable interpretation of the political prohibition contained in its Articles of Agreement. However, positive measures designed to promote respect for obligations based on human rights treaties that are binding upon borrowing States would generally not cross such a line. - International civil society groups should mobilize effectively and in coalition with groups in other sectors to advocate and promote the Social Protection Floor Initiative. Unless there is a change of heart on its part, the development community will continue to be pushed to focus on ill-defined social safety nets aimed at a limited number of the extreme poor and as a matter of bureaucratically defined and designed welfare policy, rather than as a matter of human rights. It is therefore indispensable that the human rights community should shine a spotlight on the policies and practices of the Bank in this area and the Human Rights Council should call upon it to embrace the Initiative in all its dimensions.

In the past, such policies have too often been arbitrary, inconsistent, and even counterproductive. As long as sanctions are considered to be the main element in a human rights policy, many Governments will continue to resist progress in this area. - Many of the benefits of a new convention or protocol could be achieved immediately through appropriate action on the part of the Committee on Economic, Social and Cultural Rights. It has already made an important contribution through its adoption in of general comment No. 19 (2007) on the right to social security. The content and assumptions of that general comment are entirely compatible with the Social Protection Floor Initiative, but it was adopted long before the concept of social protection floors was taken up at the international level. Thus, it does not build on the concept of social protection as such, does not use the terminology of "floors" and of course makes no reference to ILO recommendation No. 202 or other important recent developments. The Committee should give careful consideration to adopting an approach which would give much greater prominence in its work to the right to social protection. This should involve much more than just a formal statement and should include the adaptation of its methods of work so that one of its principal focuses is on the steps taken at the national level by each State party to the Covenant to establish a social protection floor. The Committee could also set up a working group to monitor progress in relation to social protection floors and to facilitate a more interactive and participatory process to enable it to make a major contribution to the international campaign to establish universal social protection.

- One of the most prominent proponents of social protection floors and a principal drafter of ILO recommendation No. 202 has called for the drafting of a "United Nations convention on national floors for social protection," on the grounds that this would "create a much more durable instrument than development goals that have to be revised every few decades". While appealing on the face of it, the proposal will certainly fall foul of the clearly demonstrated leeriness of States about creating new human rights treaties. More importantly, it takes insufficient account of the role currently and potentially played by the International Covenant on Economic, Social and Cultural Rights and the treaty body monitoring its implementation. An alternative therefore would be to propose the drafting of an optional protocol to the Covenant. However, aside from the cost and time involved in such an initiative, there is a strong general argument that new instruments should not risk making optional what is already mandatory - in this case the right to social protection under the Covenant.

Given that domestic economies are intertwined with the global economic system, in order for poverty to be reduced, national efforts must be supported by an enabling international environment. In this regard, an open, non-discriminatory, equitable and transparent multilateral trading system is essential. The Independent Expert calls on States to honour their commitments to working expeditiously towards a balanced and ambitious, comprehensive and development-oriented outcome of the Doha Development Agenda. It is vitally important that States agree on measures to address the financial and economic causes of food insecurity. The Expert urges the G20 to take immediate action to improve the regulation, functioning and transparency of financial commodity markets in order to address excessive commodity price volatility.

- International financial institutions have played a vital role in providing financial and institutional support to many developing countries during the crises and in their aftermath; however, onerous conditionalities raise several human rights concerns. States that are members of these institutions should ensure that human rights are prioritized in all policies and measures. They must ensure that the actions of the institutions do not impede the realization of human rights. - For most purposes, the World Bank is a human rights-free zone. In its operational policies, in particular, it treats human rights more like an infectious disease than universal values and obligations. The biggest single obstacle to moving towards an appropriate approach is the anachronistic and inconsistent interpretation of the "political prohibition" contained in its Articles of Agreement. As a result, the Bank is unable to engage meaningfully with the international human rights framework, or to assist its member countries in complying with their own human rights obligations. That inhibits its ability to take adequate account of the aspects of its work within countries relating to the social and political economy and contradicts and undermines the consistent recognition by the international community of the integral relationship between human rights and development. It also prevents the Bank from putting into practice much of its own policy research and analysis, which points to the indispensability of the human rights dimensions of many core development issues.

- Sixth, and most important, the debates over social protection floors and basic income need to be brought together. They have thus far been kept largely separate, in a counterproductive and ultimately self-defeating way. It is true that there are points of divergence between the two concepts, but they have vastly more potential if their synergies are recognized, rather than being ignored. Among the differences are the following: (a) the social protection floor mostly draws on experience in developing countries, while basic income advocates tend to emphasize developed countries; (b) social protection floors aim to guarantee both income security and access to essential social services, while basic income schemes only guarantee income; (c) the concept of basic income security is broader than basic income cash transfers, since it also includes in-kind transfers; (d) social protection floors focus not only on achieving social guarantees for all, but also on gradually implementing higher standards; (e) social protection floors are not viewed as alternatives to social insurance institutions, while some basic income proponents aim to replace existing social insurance institutions; and (f) the Social Protection Floors Recommendation, 2012 (No. 202) is premised upon human rights, unlike most basic income schemes. But the proponents of the two approaches have an immense amount in common, and if it is recognized that basic income is not an idea that can be achieved in a single leap, there could be no better and more elaborate and widely supported programme than that for the social protection floor.

- The sheer surprise with which the most recent crises took the international community is telling not only of the rapidity of transmission of the crises, but of the inability of States to predict and prepare for shocks and to understand the multiple dimensions of poverty. In order to better inform policy debates on how best to prioritize the human rights of the most vulnerable and disadvantaged, States need to be able to identify them more accurately and efficiently and to assess their needs. To this end, States should work towards creating mechanisms that provide better information about the incidence and substance of deprivation and inequality. This includes instituting means of gathering larger quantities of better quality disaggregated data on the impact of the crises and of recovery policies. Data should be disaggregated according to several dimensions, such as gender, age, geographical location, ethnicity and health status. It is also crucial that, in the face of rising food prices, States monitor in a timely manner the development of local food prices in order to ensure prompt and appropriate policy responses.

States should therefore conduct regular time-use surveys, with a view to recognizing, reducing and redistributing unpaid care work.

- Given the great diversity of social contexts, there is no "one size fits all" solution for ensuring access to justice for persons living in poverty. Differing national and local contexts create a variety of challenges and opportunities for reform that must be taken into account. Success in all contexts, however, will share the features of a human rights-based approach. Solutions require tackling not only legal obstacles but also a range of extralegal factors: social, economic, cultural, linguistic, etc. Solutions must be sought at local levels, designed and implemented with the active participation of the communities affected. Therefore, policymakers and legal authorities should have a specific contextual understanding of local legal institutions and the variety of obstacles on the ground that impede access to justice by persons living in poverty, and implement multidimensional solutions that can strengthen their agency and ensure their enjoyment of their rights. Special attention must be paid to women and groups that are particularly excluded, such as indigenous peoples, older persons and migrants. With this in mind, States must take immediate and effective action to ensure that persons living in poverty are not denied enjoyment of their human rights because of insurmountable obstacles which prevent them from accessing the justice system. To this end, the Special Rapporteur wishes to present the following recommendations.

- Despite the rhetoric of indivisibility, both national and international endeavours to promote and protect economic and social rights are overshadowed by the assumption that while economic and social rights are desirable long-term social goals, they should not be treated as full-fledged human rights. The present report is not the place to review in detail the familiar arguments that have been invoked in support of this approach, which include claims that economic and social rights are too expensive, too vague, too empowering of the State, are potentially limitless, reward and encourage laziness, penalize wealth creation, undermine economic growth and are inimical to international competitiveness. These arguments, traditionally associated with those who might describe themselves as libertarians, neo-conservatives, free-marketeers or small government advocates, have triumphed in many countries in the twenty-first century and have been actively promoted by the most influential international organizations in the fields of development, finance and trade. While compelling counter-arguments have been put forward in response to each of the critiques, the biggest challenge by far is essentially ideological. The economic and political power of entrenched elites is best protected by policies that marginalize economic and social rights.

- When contemplating widening the tax base, human rights principles require careful consideration to be given to rebalancing the tax contributions of corporations and those in high-income brackets. The introduction of new or higher taxes should not have a detrimental impact on those living in poverty. Improving the efficiency of tax collection requires reconsidering ineffective tax holidays, exemptions and waivers that disproportionally benefit better-off segments of society. A human rights approach also requires States to take steps to eliminate the prevalence of tax evasion, a problem that reduces the resources available for measures to realize human rights. Consideration should also be given to reprioritizing spending on social sectors (such as education and health) over, for example, military expenditures in order to ensure the maximum use of available resources for the realization of economic, social and cultural rights. As discussed below, a human rights approach requires States to debate fiscal options openly, avoiding technocratic decisions being made behind closed doors, and instead allowing for greater transparency and participation.

- Future advocacy for social protection floors needs to acknowledge the lessons that are to be learned from past experience. First, the reality is that in many states the political will to eliminate poverty is lacking and, in the absence of a major change in priorities, the situation will at best improve only incrementally. Far from being a tragedy about which nothing can be done because of financial constraints, the persistence of extreme poverty is the result of a series of deliberate and conscious decisions by key actors who have chosen to prioritize other goals. Those living in poverty have been largely disempowered and their economic position reflects their political marginality. Extreme poverty remains a scourge which the international community has lamented at great length and with a collective gnashing of teeth, but that same community has all too often refused to take the measures required to eliminate the problem. Embracing the Social Protection Floor Initiative would constitute a compelling change of course and mark a genuinely new beginning in the struggle against extreme poverty.

- The recovery from the crises presents an opportunity for States to ensure a social protection floor for everyone under their jurisdiction. This concept refers to a minimum level of social protection that everyone should enjoy. A national social protection floor is a basic set of rights and transfers that enables and empowers all members of a society to have access to essential services (such as adequate nutrition, health, education, housing, water and sanitation) and income security (through social transfers). The term "social floor" can correspond to the existing notion of "core obligations", to ensure the realization of, at the very least, minimum essential levels of economic, social and cultural rights.

In this regard, respect for all human rights, including the rule of law, gender equality and empowerment of women, inclusive participation, freedoms of association and expression, and equal access to public services are essential for poverty reduction. According to the circumstances of each State, national development strategies should also support small-scale farming through land redistribution, equal access to financial services and ensuring access to public services and infrastructure in rural areas.

- Fiscal and macroeconomic policies are no exception. In order to better uphold the human rights of women caregivers living in poverty, States should, inter alia, design tax systems to proactively promote an equal sharing of both paid and unpaid work between women and men, and implement food and fuel price stabilization policies. Especially given the effects of unpaid care on productivity and the labour force, States should analyse and design macroeconomic policy taking into account unpaid care. Expenditure cuts must not be made in ways that add to the amount of unpaid work that women have to do in families and communities. Similarly, employment creation programmes must not ignore the reality of unpaid care work, as the long-term effects of precarious work, and care deficits to children, ill or elderly persons may far outweigh the short-term gains in income for individuals or countries.

- In other words, even when it appears to be marginal and best ignored, the legal framework of recognition or non-recognition will, in practice, wield significant influence in terms of how economic and social rights are perceived and what advocacy opportunities are closed down or opened up. The legal framework can, at least partially, empower or disempower and legitimize or delegitimize those who advocate respect for economic and social rights. Thus, even those who argue that the battle over economic and social rights will inevitably be won or lost in the political arena would be well advised not to neglect the recognition, institutionalization and accountability dimensions. - It is important to recognize that the promotion of economic and social rights as human rights, including a particular emphasis on the elements of the RIA framework, does not imply that there is a universal one-size-fits-all approach that will secure the realization of economic and social rights in countries with very different histories, legal systems, traditions and cultures. Nor does it assume that everything needs to be done at once, or that a maximalist approach is indispensable. There is immense space for the processes of "vernacularization", or translation into languages and forms, that are meaningful at the local level and about which various authors have written with great insight.

- States have three levels of obligations with regard to human rights: to respect; to protect; and to fulfil (E/C.12/GC/21, para. 48). In terms of the right to participation, the obligation to respect requires States to refrain from interfering, directly or indirectly, with the enjoyment of the right. For example, States must not close down participatory spaces, impose censorship, repress public deliberation or retaliate against those who speak out (e.g. through violence, confiscation of property or incarceration). The obligation to protect requires States to take steps to prevent third parties (including business enterprises or private individuals) from interfering in the right to participation. This would include safeguarding participatory spaces, protecting freedom of expression through law and policy, and protecting individuals from reprisal from non-State actors. It also requires States to protect social movements, community organizers and human rights defenders. Lastly, the obligation to fulfil requires States to facilitate, promote and provide for the full realization of the right to participation, through appropriate legislative, administrative, judicial, budgetary and other measures. This includes strengthening skills and capacity of the public and officials, presenting meaningful decisions for public deliberation and devoting resources to long-term, sustainable participatory mechanisms to influence national priorities, programmes and decisions.
